approved a few weeks good by voters in colorado and in washington. but the real question is how is that going to square with what the federal laws are which of course outlaw marijuana and you know, cbs news has obtained a key memo from federal prosecutors that suggest their position on this conundrum. >> federal law prohibits marijuana possession. the department of justice pointed to a memo from the deputy attorney general. persons who are in the business of cultivating selling or distributing marijuana are in violation of the controlled substances act regardless of state law. that left colorado's governor caught between federal law and his state. >> would you be advocating for this law with the federal government? >> i think as most people know, i didn't support the initiative. but you can't argue with the will of the voters. right. we are here in a democracy. and the sentiment was pretty clear. >> last week, jair et polis who is a democrat, a congressman from colorado, sent a letter to the department of jus

. why? can you take more from the middle class? of course, all washington agrees from that, don't take half from the defense contractors they must be defended. we're going to do a grand bargain instead. if we did nothing the bush tax cuts would expire. that's awesome. unemployment benefits would expire. that's bad. payroll tax cuts would expire. alternative minimum that would would be expiring. the alternative minimum tax needs to get fixed by both sides. i don't see what the big thing is. in fact, right now according to the deal, the grand bargain it would take $3 in spending cuts and only raise taxes by one dollar. they're looking at $4 trillion. let me do some quick math. at in the old thing they're trying to get rid of, they're trying to get rid of $2 trillion in spending cuts. in the other $3 trillion. they would take away like we were going to cult the defense contractors. they would get rid have that and take it all from the middle class and poor. i think this grand bargain is horrible! but no no, president obama says we must protect the defense contractors. in the middle of a d

respect them. dear president we urge you to respect the wishes of the voters of colorado and washington and refrain from federal prosecution of the inhabit ants of that state who will be following their states law with regard to the use of marijuana. that makes a ton of sense and if you agree with states right you would certainly adhere to that. but in essence they're saying leave colorado and washington alone. i think we have them on tape saying it. >> leave--alone! >> cenk: there is some chance that wasn't them. bringing in ana kasparian michael shure, jayar jackson here to talk about this. guys before we get into the conversation, oh how how much does it cost us every year? $20 billion to $25 billion on this nonsense that no one thinks it's working. that does not include the cost of incarceration and prosecution, which is gigantic and dwarfs that number. first why are we still doing this if everybody thinks it's not working? don't we live in a no sir. >> beaus people are making money off keeping it legal. prisons make a ton of money. probation officers make a ton of money. they lobby

in washington. why are we having so much trouble convincing a democratic president who just won an election based on what you are talking about who has the polls behind him from cutting the programs that are enormously popular? >> that is is the $64 question. it boggles my mind and that has to do not only with the president, but has to do with many members of congress. what we have is seen in the last number of years is republican obstructionism, republicans saying it is our way or the highway. we don't really care about things like extending the debtle ceiling and don't care about anything other than getting our own way. >> senator bernie sanders thank you so much for joining us. >> my pleasure. >> i have an answer to his conund rum. they are not stupid. i don't trust the conservative democrats in the senate they will do romney's tax plan because that's who wha the donor's paid for. >> i think an easy solution is getting rid of the social security tax cap. anybody making over $110,000 stops paying into the

no willingness to break away from the tea party orthodox in washington and that's really upsetting to people. so i think when undecided voters are making up their mind, they shouldn't believe mcmann when she says she's an independent voice. they should look at what she actually stands for and she is in lock step with the tea party and in some instances further to the right of them. so that's what's going on here in connecticut. i think people are waking up to the reality that linda mcmann could be the 51st vote for a very destructive republican majority in the united states senate and they don't want to be a party to that in this state. >> and you're not going to follow the tradition of joe lieberman in terms of democrats from connecticut right? >> senator lieberman and i have add differences over the years whether it be on our positions on healthcare or the war i'm going to cut my own path. >> chris murphy. we appreciate it. we'll see how it turns out for you in the election tomorrow. all right. now, when we come back, we've got predictions very specific predictions. how many electoral votes, h
